Terms of Use and Conditions
The services provided through the website “www.mytherapist.gr”, through the mobile application under the distinctive title/name “myTherapist”, as well as through any other medium bearing the distinctive title/name “myTherapist”, belong to the company “INOVAT PC”, hereinafter the “Company”, which has been incorporated and operates in accordance with the laws of Greece and is managed by it.
These Terms of Use and Conditions apply to both “Users” and “Psychologists” who cooperate with the Company in order to provide their services through the Company’s infrastructure, services and tools . “User” stands for the simple visitor, the registered user, and also the client, namely the user who has purchased a subscription package for access to and use of the platform, through which the user contacts with their “Psychologist”. “Psychologist” stands for the person who holds a license to practice the profession of psychologist, has provided all required documents in accordance with the Company’s policy, and has successfully completed registration on the platform as a psychologist. These Terms of Use and Conditions apply to the website, the mobile application, as well as any other medium used by the Company to provide its services.
Consent to Use
The content of these Terms of Use and Conditions as well as the Personal Data Protection Policy constitutes a legal document that is binding on you when you use the services provided by the Company through any medium. Please read these Terms of Use and Conditions and the Personal Data Protection Policy carefully. If you decide to use any medium of the Company, we consider that you have read and fully accepted the Terms of Use and Conditions as well as the Personal Data Protection Policy. If for any reason you do not agree with either the Terms of Use and Conditions or the Personal Data Protection Policy, you must immediately stop using the services provided by the Company through any medium.
Registration on the Company’s platform requires the creation of a personal account, both for the User and for the Psychologist. In all cases, the User and the Psychologist must read and accept the Terms of Use and Conditions as well as the Personal Data Protection Policy, and proceeding with registration implies their full acceptance.
Changes to the Terms of Use and Conditions and/or the Personal Data Protection Policy
The Company has the right to amend/update the Terms of Use and Conditions and/or the Personal Data Protection Policy. The date of the latest update to the Terms of Use and Conditions and the Personal Data Protection Policy is displayed at the beginning of each document. Any amendment/update may take place at any time, without prior notice, and takes effect upon publication of the updated version across all Company channels. For each amendment/update, the Company will notify you through at least one medium, such as by sending an informational email, sending a relevant notification through the mobile application, posting a relevant notice on the website, or by any other service or tool the Company may use. Upon any notification, you should review the changes to the Terms of Use and Conditions and/or the Personal Data Protection Policy to ensure that you agree with and accept any changes. If you continue using the Company’s services, it implies that you fully consent to the Terms of Use and Conditions and the Personal Data Protection Policy.
Introduction
The Company offers Users the ability to connect and communicate with Psychologists who cooperate with the Company as contractors and are available on the platform. The platform provides an easy to use and secure environment that facilitates communication between the User and the Psychologist, eliminating distance barriers. In particular, the platform enables online chat, voice calls, and video calls between the User and the Psychologist. Through the platform, Psychologists provide services related to mental health, such as counseling and psychotherapy.
If the User wishes to conduct online sessions through the Company’s platform, the User must create a personal user account, meaning the User will complete the requested information in a registration form, will read and accept the Terms of Use and Conditions and the Personal Data Protection Policy, and will pay the fee for the selected subscription package.
The platform also aims to inform Users on matters related to mental health, for example by publishing articles published by Psychologists.
Finally, the User may contact a Company associate in order to receive assistance with using the platform (for example in the event of technical difficulties). This associate is not a psychologist and does not provide counselling services; their role is purely supportive.
Definitions
- “Company” stands for the legal entity that provides interactive communication services with the aim of enabling Users to communicate and conduct online psychotherapy sessions with the Psychologist to whom they have been connected.
- “Platform” stands for the software/applications/infrastructure/processes, etc., owned by the Company and used by Users and Psychologists to provide counselling services. The platform is available through multiple devices and mediums.
- “User” stands for any person who uses the platform in order to receive counselling services from a Psychologist.
- “Client” is a special category of User. The additional characteristic of a Client compared to a User, is that the Client has purchased one of the Company’s subscription packages by paying the corresponding amount in order to receive counselling services from a Psychologist.
- “Personal user account” stands for the tool used by the User/Client to access and use the platform.
- “Psychologist” stands for the person who holds a license to practice the profession of psychologist, has provided all required documents in accordance with the Company’s policy, and has successfully completed registration on the platform as a psychologist. The Psychologist provides counselling services through the platform, as an independent contractor.
- “Personal psychologist account” stands for the tool used by the Psychologist to access and use the platform.
- “counselling services” stands for counselling and/or psychotherapy services provided by Psychologists to Clients through the platform.
Commitments and obligations of all persons using the Company’s services
The commitments and obligations of all Users of the Company’s services are set out below. The following commitments and obligations apply to the Users, the Clients, and the Psychologists and apply across all tools through which the Company provides its services. In particular:
- You confirm that you are at least 18 years old.
- You undertake to use all services and tools provided by the Company lawfully. In particular, you are prohibited from any act that could be considered a criminal offence, give rise to civil liability, or violate any law.
- You are prohibited from acting in a manner that violates the rights of the Company or any third party.
- You are prohibited from using the platform for advertising purposes and promoting products/services, and you are expressly prohibited from promoting unsolicited information (spam) in any manner.
- You are prohibited from acting in a manner that impedes the smooth operation of any service and/or tool, used by the Company in order to provide its services.
- You are prohibited from using or sharing malicious software, using malicious bots, and generally using any malicious tool aimed at disrupting the provided services or damaging any Company tool.
- You are prohibited from using or disseminating illegal, threatening, offensive, racist, or any other material that may cause criminal conduct, violate any law, infringe intellectual property, or violate the rights of the Company or any third party.
- You are prohibited from publishing/uploading confidential information in any manner.
- You acknowledge that you are solely responsible for the files you receive through any tool provided by the Company. Before downloading, opening, or using any file, you must scan it for potential viruses or harmful software using software available on your device. The Company bears no liability for any damage resulting from the transfer or dissemination of viruses and/or harmful software due to the fault of Users or Psychologists.
- The sharing of personal contact details (e.g. email, telephone, Facebook profile, home address, etc.) through the platform is prohibited. Communication between the Psychologist and the Client must be conducted exclusively through the platform’s secure infrastructure. In the event of communication outside the platform’s secure infrastructure, the Company is not liable for any potential data leakage or any other damage.
- Following the purchase of a subscription package by the Client, the Client is asked to provide contact details for emergency situations. These details may be requested by the Psychologist through the relevant option in the platform and may be used only in the event of an emergency. Communication outside the platform’s secure infrastructure between the Client and the Psychologist is permitted only through the above process and only in an emergency situation.
- You are prohibited from collecting any User data by any tool for the purpose of unsolicited communication (commercial or otherwise). Any details available on the platform exist solely to facilitate communication through the platform.
User obligations
- To use the platform, creation of a personal user account is required, which presupposes the provision of specific information.
- You accept the retention and processing of your personal data, as provided by you during registration, by the platform administrators. In particular, the Company’s administrator will keep a record of your personal data in accordance with the terms and requirements of the EU General Data Protection Regulation 679/2016/EU, as in force, and is obliged to comply with the provisions of Law 2225/1994 and Presidential Decree 47/2005 regarding the lifting of confidentiality to any judicial authority, for reasons of national security or for the investigation of particularly serious crimes and for any reason provided by law, following the procedure prescribed by law. More information regarding the collection and management of your personal data can be found in the Personal Data Protection Policy document (https://mytherapist.gr/en/privacy-policy).
- You undertake to provide the necessary information to create your personal user account.
- You undertake not to create more than one personal user account, nor to create a personal user account on behalf of third parties.
- You undertake to provide true, accurate, up to date, and complete information when creating your personal user account.
- You undertake to provide true, accurate, up to date, and complete information (first name, last name, and address) in order for the lawful tax document (receipt for services) to be issued. The Company bears no responsibility for the accuracy of such information.
- You undertake that during your subscription you will update all information so that it remains accurate and complete. If the Company identifies false, incomplete, or inaccurate information, it may partially and/or fully discontinue the provided services without notice and without any liability.
- You agree and accept that you are solely responsible for maintaining the confidentiality of your login details (email, username, and password), as well as any other security information related to your personal user account, and therefore the Company bears no liability if your personal user account is used by a third party due to your failure to maintain confidentiality.
- You undertake to notify the Company immediately in the event of unauthorised use of your personal user account or any other breach of your account security.
- You agree and accept that you are solely and exclusively responsible for all actions carried out through the platform using your personal user account. You agree and accept that you are solely responsible for any damages caused to the Company or any third party due to unauthorised use of your personal user account arising from your own fault.
- Registration on the platform for the Client is carried out using a username and password, or using a Google account, a Facebook account, or an Apple account. In all such cases, the User must maintain the confidentiality of their login details and the Company bears no liability in the event of breach of the personal user account due to a breach of the User’s Google, Facebook, or Apple accounts.
- You undertake to ensure that all communications (chat, voice call, video call, etc.) take place in an appropriate location and that the confidentiality of the information exchanged through the platform is not compromised.
- Recording and/or transferring the content of your communications (chat, voice call, video call, etc.) carried out through the platform to any third medium is prohibited. The Company provides high security technologies to safeguard the privacy of conversations. However, if information is transferred to a third medium, the Company bears no liability for any leakage.
- You agree and accept that you use the platform and the services provided by your Psychologist exclusively for personal use and not on behalf of or for any third person.
- You agree that you must be consistent with your appointments so as not to disrupt your Psychologist’s schedule and to avoid missing an appointment. You may cancel and reschedule a scheduled appointment, but you do so at your sole responsibility, as there is a possibility that you may miss your appointment. We recommend that you check your Psychologist’s availability, confirm that availability exists, then verify that you are within the period covered by your subscription, and only then cancel a scheduled appointment. This minimises the likelihood of missing an appointment.
- You agree that you must schedule your appointments in a timely manner. We recommend scheduling appointments with a few days between them to support the effectiveness of the therapeutic process. It is also recommended not to schedule appointments in the last days and hours of your subscription, because if an appointment is cancelled, it is very likely that no availability will exist for rescheduling and the appointment will effectively be lost.
- The platform does not provide mental health services and therefore the role of the Company and the platform is strictly limited to facilitating communication between the User and the Psychologist so that counselling services can be provided via online communication. The platform’s sole purpose is to facilitate the provision of counselling services and it is not intended for psychiatric diagnosis or prescribing. If you receive information through the platform related to medication, you should disregard such information and you are advised to contact the Company immediately to report the incident.
- In emergency situations, you must NOT use the services provided by the Company through the website, the mobile application, or any other tool. In emergency situations, such as suicidal thoughts contact your psychiatrist, go to the nearest psychiatric clinic, call emergency or suicide & crisis lifeline of your Country.
Subscription Packages and Payments
Payments made on the platform are made by Clients through electronic payment methods and in accordance with the Company’s pricing policy, which may change at any time and the Company is not obliged to provide prior notice. In particular, the Company reserves the right to change at any time and without prior notice the prices of subscription packages or to apply discounts through coupons in multiple forms (e.g. one time use, percentage discount, first purchase discount, discounts for specific customer groups, etc.). The Client creates a subscription for a predetermined period during which the Client uses the payment methods (for example credit, debit, prepaid cards, etc.) registered on the platform to pay the recurring subscription. For the execution of electronic payments, the Company uses Stripe’s secure servers. The Company does not retain any data related to electronic payments and all data are transferred to and processed within Stripe’s secure and certified infrastructure. With respect to the terms of use and privacy policy related to payments, you may refer to Stripe’s relevant page (https://www.stripe.com/en-gr/privacy). The subscription package selected and purchased by the Client is essentially a prepayment in order to gain access to the platform and receive counselling services from the Psychologist you connected to. The terms of the Client’s subscription, take effect from the start until the end of the Client’s subscription. The Client must maintain one or more valid payment methods and, upon registering one or more valid payment methods, the Client consents to the Company charging one or more of these payment methods for the provided services, automatically and on a recurring basis. The Client agrees to pay the amount due at regular intervals as defined by the selected subscription package. The Client may add, remove, and/or modify payment methods through the platform. The Client will receive notification regarding each completed payment through the platform. The Client may also cancel the subscription at any time through the platform, which results in non renewal of the subscription for the next period but does not, in any case, result in a refund of any amount paid for the current or any past period. From the moment the Client requests cancellation of the subscription, it is at the Client’s discretion whether to continue using the prepaid services. As a consumer, the Client generally has the right to withdraw from the contract concluded electronically within 14 days from the date the contract is concluded electronically through our platform. It is noted that the Client does not have the right of withdrawal if the Client has used the service (for example, has completed a session with the Psychologist or has reserved the Psychologist’s time by scheduling a session). Subscription cancellation is initiated by the Customer through the relevant option available on the Platform. However, if the Platform identifies that a Customer’s subscription has been renewing without any use of the Service for more than five (5) months, the Platform may cancel the Customer’s subscription in order to prevent recurring charges. In such case, the Customer shall not be entitled to a refund, except in exceptional circumstances and at the Company’s sole discretion. If the Client’s subscription is interrupted for reasons not related to the Client, the Company will examine each case individually and, depending on the circumstances, will decide whether a refund will be made, whether the subscription package will be cancelled without refund, or whether the Client’s subscription package will be renewed at a reduced price through the use of credits.
Appointments, Cancellations, and Non attendance at a scheduled appointment
Conduct of a scheduled appointment
Appointments are scheduled by the Client through the platform at times the Psychologist has indicated as available. To schedule an appointment, the Client’s subscription must be active and the appointment must fall within the subscription period. Additionally, the appointment must be scheduled at least a few hours before its start time (this setting is configured by each Psychologist individually and may vary by case). Before the appointment begins, you will be notified through the platform. As a rule, appointments should start and end at the times scheduled. For flexibility, either the Client or the Psychologist may request through the platform that the appointment take place earlier than the scheduled start time or later, but always within the same calendar day as the scheduled appointment. This functionality is purely supportive. For example, if an unexpected event occurs for either the Client or the Psychologist, they may agree to conduct the appointment with a one hour delay. In any case, this “informal” change must be on the same day as the scheduled appointment, and if for any reason proper coordination does not occur and the appointment is missed, the Company bears no liability. Once the appointment begins, it proceeds for the duration specified by the Client’s subscription package, and upon completion of the defined time, the appointment is marked as completed.
If the appointment (voice call or video call) cannot be conducted or cannot be completed due to a technical issue, the Client must contact the Company so that the technical issue to be resolved. If the issue is caused by the Client’s equipment or the Client’s internet connection, the Company bears no liability and is not obliged to take any action to resolve it. If the issue is identified within the platform’s infrastructure, the Company must restore proper operation, and if this is not possible and the Client’s appointment is ultimately missed, the Company must either give the chance the customer to book the appointment again, or provide a partial refund corresponding to the amount of the appointment(s) not conducted, if the Client does not wish to renew the subscription.
Non scheduled appointments
The Client must schedule appointments within the time period defined by his subscription. If for any reason the Client does not schedule an appointment in time and ultimately does not conduct it within the time limits of the current subscription, that appointment will be carried over to the next subscription renewal, provided that the subscription renewal occurs within less than 15 calendar days from the expiry date of the initial subscription. Otherwise, if either 15 calendar days have elapsed from the expiry date of the initial subscription or the Client cancels the subscription, any appointments not scheduled are lost and the Client is not entitled to any compensation. Finally, the Client may request an extension of the subscription and the Company, after reviewing the Client’s request, may extend the subscription for a number of days. Extension requests are reviewed on a case by case basis and it is at the Company’s sole discretion whether to grant an extension, based on accounting and technical factors.
Cancellation of an appointment by the Client
The Client may cancel through the platform up to 4 appointments within the period covered by the subscription. To cancel an appointment, cancellation must be made at least a few hours before the appointment start time (this setting is configured by each Psychologist individually and may vary by case). Once the Client cancels an appointment, the Client may reschedule it for the desired day and time. The Client should use this functionality prudently so as not to disrupt the Psychologist’s schedule and to avoid unavailability that may cause the Client to lose the appointment. In particular, once an appointment is cancelled, the Client may reschedule it within the remaining days until the end of the subscription. If the Client cancels an appointment without first checking the Psychologist’s availability, the Client may not find an available time slot to conduct the appointment. In such a case, if the Client renews the subscription, the cancelled appointment(s) are carried over to the next subscription period, provided that the renewal occurs within less than 15 calendar days from the expiry date of the initial subscription. Finally, if the Client cancels an appointment, subsequently cannot find availability to reschedule it, and does not wish to renew the subscription, the appointment is lost and the Client is not entitled to any partial or full refund.
Cancellation of an appointment by the Psychologist
The Psychologist undertakes not to cancel appointments and to make best efforts to provide services without interruption. However, in special cases of force majeure, the Psychologist may cancel an appointment. In such a case, the Client may reschedule the appointment within the period covered by the subscription. If an appointment is cancelled by the Psychologist, the Client may not find an available slot to reschedule it. In such a case, if the Client renews the subscription, the appointment(s) cancelled by the Psychologist are carried over to the next subscription period, provided that the renewal occurs within less than 15 calendar days from the expiry date of the initial subscription. Finally, if the Psychologist cancels an appointment, the Client subsequently cannot find availability to reschedule it, and the Client does not wish to renew the subscription, the Client must contact the Company in order to receive a partial refund corresponding to the appointment(s) that did not take place because they were cancelled by the Psychologist. The above terms also apply where a Psychologist requests cancellation of an appointment to the Company and the cancellation is executed by a Company administrator.
Cancellation of an appointment by a Company administrator
If the Client has used the ability to cancel all 4 appointments through the platform and wishes to cancel additional appointments, the Client must contact the Psychologist or the Company, and it is at the discretion of the Company and the Psychologist whether to accept the appointment cancellation request, taking into account parameters such as the Psychologist’s availability and the Client’s overall consistency in attending appointments. If the appointment is cancelled, the Client will be able to reschedule it through the platform at the desired time and day. The Client must use this functionality prudently so as not to disrupt the Psychologist’s schedule and to avoid unavailability that may result in losing the appointment. In particular, once an appointment is cancelled by a Company administrator, the Client may reschedule it within the period covered by the subscription. If an appointment is cancelled by a Company administrator, the Client may not find availability to schedule it again. In such a case, if the Client renews the subscription, the appointment(s) cancelled by a Company administrator are carried over to the next subscription period, provided that the renewal occurs within less than 15 calendar days from the expiry date of the initial subscription. Finally, if a Company administrator cancels an appointment, the Client subsequently cannot find availability to reschedule it, and the Client does not wish to renew the subscription, the appointment is lost and the Client is not entitled to any partial or full refund.
Client non attendance at a scheduled appointment
If, for any reason, the client does not attend their scheduled appointment, they must contact their psychologist via the platform as soon as possible and within the same calendar day as the scheduled appointment date. If feasible, the psychologist may hold the appointment later that same day so that it is not lost; however, they are not obliged to do so. Specifically, it is at the psychologist’s sole discretion whether to accept and conduct the appointment at a later time, and the Company bears no responsibility for the final outcome of the appointment. If the appointment is not ultimately conducted on the same day, the psychologist is required to decide whether the client will lose the appointment or whether the client will be given the opportunity to reschedule it. In cases where the psychologist chooses for the appointment to be permanently lost, it must be justified that the appointment was missed due to the client’s fault in full (100%). If the psychologist chooses to allow the client to reschedule the appointment, the rescheduled session must take place within the period covered by the client’s current subscription. For any appointment that the psychologist has allowed to be rescheduled, if it is not completed within the time limits of the client’s current subscription, that appointment will be carried over to the next subscription renewal, provided that the subscription is renewed within less than fifteen (15) calendar days from the expiry date of the original subscription. If the client does not wish to renew their subscription, the appointment is lost and the client is not entitled to any partial or full refund.
Psychologist non attendance at a scheduled appointment
If for any reason the Psychologist does not attend a scheduled appointment, the Psychologist must contact the Client as soon as possible through the platform. If feasible, the appointment will be conducted within the same day in order not to lose it, but this is not mandatory and the Company bears no liability for the final outcome. If the Psychologist does not attend the scheduled appointment and the current day passes, the appointment will either be carried over upon the next renewal of the package, provided that the renewal occurs within less than 15 calendar days from the expiry date of the initial subscription, or it will be lost if the Client does not wish to renew the subscription. In the latter case, the Client must contact the Company in order to receive a partial refund corresponding to the amount of the appointment(s) not conducted because the Psychologist did not attend.
In all the above cases where it is stated that upon renewal of the subscription the sessions not conducted are carried over into the next subscription period, this applies exclusively to sessions within the current subscription period. If there are sessions from previous months’ subscriptions, they are lost and the Client is not entitled to any compensation. For example, for a monthly subscription, upon renewal, sessions from the previous month are carried over, while sessions from the month before the previous month are lost and the Client is not entitled to any compensation. Additionally, in all the above cases where carry over is stated upon renewal, a necessary condition is that the renewal occurs within less than 15 calendar days from the expiry date of the initial subscription. Otherwise, if either 15 calendar days elapse from the expiry date of the initial subscription or the Client cancels the subscription, any appointments not conducted are lost and the Client is not entitled to any compensation.
Connection with a Psychologist and change of Psychologist
Although we have a large network of Psychologists that continues to expand, it is not possible to connect you with any Psychologist you may want at any time, as each Psychologist’s availability changes continuously. For this reason, your connection with your Psychologist is made by the platform taking into account each Psychologist’s availability and other criteria. Connection with your Psychologist is performed automatically by the platform by combining multiple data points with the use of artificial intelligence, with the aim of connecting the Client with a suitable therapist. However, there may be cases where the Client wishes to transfer to a new Psychologist. The platform provides the ability to change Psychologists through the relevant option. To be transferred to a new Psychologist, you fill in all required information requested so that we can connect you with a suitable Psychologist. The information you submit as part of a transfer request is evaluated in combination with other parameters such as the availability of Psychologists on the platform, in order to connect you with a new Psychologist. If the Psychologist to whom you are connected has no availability or temporarily or permanently ceases using the platform, the platform will connect you with a new Psychologist and will notify you of the connection. In all cases, by creating your subscription you have prepaid for the services to be provided, and if you are not satisfied with the connected Psychologist, you have the right to request a transfer to a new Psychologist, but you are not entitled to any compensation or refund.
Regarding Psychologists
Psychologists are not part of the Company, do not have a direct dependent employment relationship with the Company, and therefore the Company bears no responsibility for any act or omission of any Psychologist. Psychologists are external contractors who use our platform in order to provide their services. The Company bears no responsibility for the suitability or otherwise of a Psychologist, or for whether the counselling services are correct, appropriate, or tailored to the Client’s needs. The Psychologist is solely responsible for the responses provided via chat or online sessions. The Company does not control the quality of counselling services and does not determine whether any Psychologist has the appropriate qualifications for each Client’s needs. The Company checks the information provided by the Psychologist, whether the Psychologist holds a license to practice the profession of psychologist, as well as certain other documents submitted during the Psychologist’s registration application. In all cases the Company performs checks of all information and documents, but does not guarantee the accuracy or validation of such documents. The Company provides the platform as a tool enabling independent contractors (Psychologists) to provide their services. Through the platform, a network of Psychologists has been created, that provides services to Clients. Therefore, counselling services are strictly linked to the Psychologist. The Company is not involved in the relationship between the Client and the Psychologist and does not participate in the provision of counselling services.
The Psychologist agrees that they are responsible for maintaining the confidentiality of their password and any other security information related to their personal account. Therefore, the Company bears no liability if the Psychologist’s personal account is used by a third party due to the Psychologist’s failure to maintain confidentiality. The Psychologist undertakes to notify the Company immediately in the event of unauthorized use of their personal account or any other breach of account security. The Psychologist agrees that they are solely responsible for all actions carried out through use of the platform.
Regarding Psychologists who have provided profile information and/or psychology articles but have not concluded a cooperation agreement with the Company, the Company may delete at any time the content of their profile and/or the articles they have published, without prior notice. If the Psychologist wishes deletion of their profile information or articles submitted for publication, the Psychologist must submit a written request to the Company and the Company will delete the requested information within the period provided by law.
Termination of provided services
The Company reserves the right to terminate all or part of the services it provides at any time without prior notice and without any liability.
Without prejudice to any of its rights, the Company reserves the right to restrict, temporarily suspend, and/or permanently discontinue access to all or part of the platform for any User or Psychologist, at the Company’s discretion, without notice and without any liability. In particular, in the event of breach by the User of the Terms and Conditions of Use and/or the Personal Data Protection Policy, the Company may fully disconnect the User’s personal account, either indefinitely or until full compliance by the User. In such a case, the User is not entitled to any compensation due to discontinuation of services, unless, at its sole discretion, the Company decides otherwise.
In the event of permanent discontinuation of the provided services, the Psychologist providing mental health services as well as the User may request permanent deletion of the profile created and all related information by submitting a relevant written request to the Company.
Intellectual property
All content of the platform, excluding the profile information published by Psychologists and the content they publish (for example, articles), constitutes the Company’s intellectual property and is protected by applicable national, European, and international law. Platform content includes all trademarks/logos/photographs/names/texts/software, etc. With respect to such content, any use by any person (for example publication, distribution, modification, or exploitation in any manner) is prohibited without the Company’s prior written permission. The profile information published by Psychologists and the articles they publish are the property of the respective Psychologist. The Company may amend/correct information uploaded by Psychologists, such as profile content or psychology articles. For example, the Company may correct spelling or grammatical errors, shorten phrases so that the profile description is brief and concise, improve the profile image, remove references to websites, contact details, etc. However, the content of articles, profile descriptions, texts, and images uploaded by Psychologists to the platform remains under the exclusive responsibility of the respective Psychologist, and the Company bears no responsibility regarding the content, accuracy, correctness, or intellectual property rights of materials published by Psychologists, as the Company only makes minor edits to the original content produced by Psychologists. All profile information of Psychologists and articles submitted for publication, after the above edits and modifications, are published across the Company’s media. If a Psychologist wishes modification or deletion of any of the above items, the Psychologist must contact the Company in writing and the Company will evaluate the request.
The platform may contain hyperlinks to third party websites to facilitate Users. The websites to which hyperlinks exist are subject to the terms of use and conditions and/or privacy policy of those websites. Therefore, the Company bears no responsibility for their content or accuracy, or for services provided through them.
Limitation of liability
The Company provides no warranty of any kind regarding access to services provided through the platform. In particular, the Company does not guarantee uninterrupted or error free operation of the provided services. The Company makes best efforts to protect the platform and all tools it uses from viruses and any other harmful files and/or programs, however it cannot guarantee that it will never be affected by such elements. The Company also does not guarantee that the platform and any other tools used will be fully compatible with each User’s device, hardware, and software. Users and Psychologists agree and accept that the Company may modify, temporarily suspend, or permanently discontinue operation of all or part of the platform, with or without prior notice. The Company cannot control or guarantee the proper functioning of telecommunications tools, internet connection, and all technical tools used by the User and the Psychologist. Therefore, the Company bears no liability for any damage due to the above reasons. Finally, Users and Psychologists agree to use the services as is and at their own risk.
Users and Psychologists are responsible for any destruction or damage caused to the Company’s services, to the Company’s information systems, or for data leakage or loss, where such issues were caused through use of the User’s or Psychologist’s login credentials or any other person who gained access due to the User’s or Psychologist’s negligence.
Connection of the User with a Psychologist is carried out automatically by the platform based on Psychologists’ availability and other criteria. The User accepts that the role of the Company and the platform is auxiliary, aimed at facilitating communication. In particular, the Psychologist provides counselling services through the platform and the Company cannot evaluate such counselling services. The User agrees that the Company does not evaluate the legality, professional competence, or suitability of each Psychologist. The User fully releases the Company from any liability or damage in any way related to services provided by the Psychologist. Under no circumstances will the Company be involved in any disputes between the User and the Psychologist.
The Company does not guarantee nor bear responsibility for continuous and uninterrupted operation of its services through the platform, particularly where this is due to acts, omissions, or errors of third party suppliers (indicatively, network disconnection, system maintenance, malicious acts and attacks on third party supplier networks, etc.).
Similarly, the Company bears no responsibility for potentially poor connection quality between the Client and the Psychologist due to the network speed of third party providers and/or the tools used by them for their interconnection.

If any provision of these Terms and Conditions of Use is found invalid, this shall not affect the validity of the remaining provisions, which shall remain in full force and effect. The content of these Terms and Conditions of Use constitutes a set of binding terms that all Users and Psychologists must comply with.
These Terms and Conditions of Use are governed by and construed in accordance with Greek law. Any disputes arising from the application of these Terms and Conditions of Use will be sought to be resolved out of court, however if this is not possible, the courts of Athens shall have jurisdiction.
The Company, through its systems and software, reserves the right, indicatively and not restrictively, to carry out any of the following actions: a) to record and store any communication of the visitor/User with the Company, including email communications and questions and answers to Psychologists, b) to investigate any complaint if a communication does not comply with the Company’s Terms of Use and Conditions and to decide at its discretion to withdraw or require withdrawal of such communication, c) to withdraw communications and data and information sent by the User that are deemed offensive, illegal, or disturbing, or that do not comply with the Company’s Terms of Use and Conditions, d) to delete registered members when they do not comply with the Company’s Terms of Use and Conditions after relevant warning.
